HOUSE BILL NO. 369

AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO SHELLFISH.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


It shall be unlawful for any person to possess any conch which measures less than 5 inches in length or 2 ¾ inches in diameter at the whorl. a minimum possession size limit specified in regulations promulgated by the Department. The Department is authorized to promulgate regulations to establish the minimum possession size limit of conchs. The Department shall not promulgate regulations that increase the required length size or diameter at the whorl as specified in this section.


SYNOPSIS

This bill decreases the size of a conch that may be taken or harvested under current DNREC regulations and places the requirements specifically in the Delaware Code.
