HOUSE BILL NO. 32

AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO MANUFACTURED HOME COMMUNITIES AND THE DELAWARE MANUFACTURED HOME RELOCATION TRUST FUND.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend Section 7012(f), Title 25 of the Delaware Code by adding the following new subsection:

"(5) In any civil action brought by the Authority to collect any assessment, interest, or other sums due hereunder, the Authority shall have the right to recover from the delinquent party all reasonable court costs and attorneys fees incurred by the Authority in the prosecution of said action.".

SYNOPSIS

This Act grants the Authority the right to recover from a delinquent party all reasonable court costs and attorneys fees incurred by the Authority in prosecuting a civil action to collect any assessment, interest, or other sums due thereunder.
