HOUSE BILL NO. 281

AN ACT TO AMEND 21 OF THE DELAWARE CODE RELATING TO RULES OF THE ROAD.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §4177(f), Title 21 of the Delaware Code by designating the entirety of the existing subsection as paragraph "(1)" thereof and by adding a new paragraph "(2)" thereto as follows:

"(2)In addition to the penalties prescribed in paragraphs (3) and (4) of subsection (d) of this section, anyone convicted of a third offense or a fourth or subsequent offense shall, for a period of 6 months following their release from incarceration, be subject tosupervision by an electronic alcohol monitoring device at their own expense.".


SYNOPSIS

This act requires individuals convicted of felony level DUI offenses to be supervised, at their own expense, by an electronic alcohol monitoring device for a period of six months following their release from incarceration.
