HOUSE BILL NO. 270

AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO THE REGULATION OF FINFISHING IN TIDAL WATERS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §903(e)(1), Title 7 of the Delaware Code by adding a new subparagraph "g." thereto as follows:

"g.Regulate and/or restrict the type of fishing gear or methods which may be used within the geographical boundaries of permitted artificial reef sites within the Delaware Bay and within Delaware's territorial sea (defined as zero to three miles seaward of Delaware's ocean coastline).".


SYNOPSIS

This Act grants the Department of Natural Resources and Environmental Control authority to restrict, or define by regulation, the type of fishing activities permitted within the geographic boundaries of the artificial reef sites in the Delaware Bay and ocean waters under Delaware jurisdiction.This regulatory authority is necessary to prevent certain types of commercial fishing from interfering with the ability and opportunity for sport fishing.Delaware's artificial reef sites were built, and are maintained, partially or wholly through funds made available under the Federal Aid in Sport Fish Restoration Act to benefit sport fisheries and sport fishing.
