HOUSE BILL NO. 175

AN ACT TO AMEND CHAPTER 462, VOLUME 77, OF THE LAWS OF DELAWARE RELATING TO THE BOARD OF CHIROPRACTIC.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 462, Volume 77, of the Laws of Delaware by deleting Section 1 in its entirety and substituting in lieu thereof the following:

"Section 1.Amend §716(b), Title 24 of the Delaware Code by adding the following after the period "." at the end of the subsection:

‘Any copayment or coinsurance amount shall be equal to or less than twenty-five percent (25%) of the fee due or to be paid to the doctor of chiropractic under the policy, contract, or certificate for the treatment, therapy, or service provided.'".

Section 2.Amend Chapter 462, Volume 77, of the Laws of Delaware by deleting Section 2 in its entirety and substituting in lieu thereof the following:

"Section 2. The provisions of this Act shall take effect on January 1, 2012.".


SYNOPSIS

This bill relates to the Board of Chiropractic and makes two changes to House Substitute No. 1 for House Bill No. 435, as amended by House Amendments Nos. 1 and 2, of the 145th General Assembly, signed into law on July 30, 2010.Section 1 simplifies the process of calculating the cost sharing charged to patients for chiropractic care.Section 2 changes the effective date from July 1, 2011 to January 1, 2012.
