HOUSE BILL NO. 165

AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO THE MEDICAL PRACTICE ACT AND THE BOARD OF MEDICAL LICENSURE AND DISCIPLINE.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §1730(b)(1)a., Title 24, of the Delaware Code by striking the words "change in hospital privileges" after the word "Any" and before the semicolon";" and inserting in lieu thereof the words "partial or full removal of hospital privileges based on adverse events, unprofessional conduct or competency issues".


SYNOPSIS

This bill clarifies that the duty of physicians and health care facilities to report under this paragraph is to report changes that result in the partial or full removal of a physician's hospital privileges as the result of adverse events, unprofessional conduct or competency issues and not to report changes that enhance or add to the physician's privileges.
