HOUSE BILL NO. 108

AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO EDUCATION.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Title 14 of the Delaware Code by inserting a new Chapter 43 by making deletions as shown by strike through and insertions shown by underline and as follows:

CHAPTER 43. ELEMENTARY AND SECONDARY EDUCATION ACT

§4301 Definitions.

As used in this chapter:

(1) "Department" means the Delaware Department of Education.

(2) "ESEA" means the federal Elementary and Secondary Education Act.

§4302 Waivers.

No ESEA Flexibility waiver application shall be submitted by the Department or approved by the State Board of Education for submission to the United States Department of Education without final approval of the General Assembly by Concurrent resolution with the application attached.

Section 2. This Act shall be effective on enactment.


SYNOPSIS

This bill requires that the General Assembly approve any ESEA Flexibility waiver prior to its submission to the U.S. Department of Education.
