Summary

Volume 78, Chapter 349, of the Delaware Laws provided the State the same statutory transfer rights afforded defendants charged with Driving Under the Influence ("DUI"). The ability of both the State and the defendant to transfer misdemeanor DUI charges from the Justice of the Peace Court to the Court of Common Pleas provides for judicial economy and development of a DUI Treatment Court within the Court of Common Pleas. This Act extends the sunset provision included in the original 2012 legislation and extended in 2014 to allow further development of initiatives to address impaired driving in both the Court of Common Pleas and Justice of the Peace Court.
