This bill clarifies the role and authority of the Delaware Division of Public Health Office of Animal Welfare and Department of Agriculture regarding animal cruelty enforcement. The Office of Animal Welfare was directed by the 148th General Assembly to enforce all Delaware animal cruelty laws and the Office has since created a law enforcement unit to carry forth said direction. This bill updates the authority of the Department of Health and Social Services to enforce animal cruelty laws as directed and removes that authority from non-profit SPCAs in the State of Delaware. The Department of Agriculture is given concurrent enforcement authority as concerns farm animals.
