Summary
At present, Delaware law permits the “lawful use” of electronic tracking (GPS) devices by law enforcement. However, the Delaware Code does not define what constitutes “lawful use” or what procedures law enforcement should follow before installing and using electronic tracking. This Act sets forth procedures for investigative and law enforcement use of such devices in future cases. Those procedures ensure the standards for law enforcement use of electronic tracking meet or exceed prevailing constitutional principles. To do so, the Act adopts Delaware’s statutory authority regarding other forms of electronic monitoring by law enforcement and provides that application for installation and monitoring of GPS devices will be made in the Superior Court.
