AN ACT REQUIRING THE LICENSURE OF POLYGRAPH EXAMINERS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2011) (a) No person shall administer a polygraph examination in this state on and after July 1, 2012, unless he or she has obtained a polygraph examiner license issued by the Commissioner of Consumer Protection. Said commissioner shall grant licenses to persons who meet the qualifications specified in the regulations adopted pursuant to subsection (b) of this section.

(b) On or before July 1, 2012, the Commissioner of Consumer Protection shall adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to establish the qualifications necessary to obtain a license as a polygraph examiner. Such regulations shall specify that: (1) No employee of the federal government who administers polygraph examinations in the course of his or her employment with the federal government shall be required to obtain such a license, (2) no licensed polygraph examiner shall ask questions pertaining to sexual behavior, sexual orientation, or political or religious beliefs during the course of administering a polygraph examination unless such questions are material to the investigation, and (3) no licensed polygraph examiner shall administer a polygraph examination unless such licensed examiner uses a polygraph instrument which records permanently and simultaneously the subject's cardiovascular, respiratory and galvanic skin conductivity patterns.

This act shall take effect as follows and shall amend the following sections:
