AN ACT CONCERNING THE WAIVER OF COURT FEES IN ACTIONS FILED BY INDIVIDUALS AGAINST MUNICIPALITIES, PUBLIC OFFICIALS OR THE STATE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 52-259b of the general statutes be amended to provide that prior to waiving court fees in any action filed by an individual against a municipality, public official or the state, other than a habeas corpus writ, the court shall review merits of the action and shall not waive the payment of court fees unless the court makes a determination that such action is not vexatious, provided that in the event the court denies an application for a fee waiver, the individual may appeal such denial to the Superior Court.

Statement of Purpose:

To reduce the number of vexatious actions filed by individuals against municipalities, public officials and the state and reduce taxpayer funding of such actions.
