AN ACT CONCERNING THE PRESERVATION OF HISTORICAL RECORDS AND ACCESS TO RESTRICTED RECORDS IN THE STATE ARCHIVES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2017) Any record transferred to the state archives established in section 11-1c of the general statutes that the State Archivist determines to be a record of historical value shall be retained for posterity and title to such record shall vest in the state archives.

Sec. 2. (NEW) (Effective October 1, 2017, and applicable to requests to inspect records made on or after said date) (a) For the purposes of this section:

(1) "Public record" has the same meaning as "public record or file" in section 1-200 of the general statutes; and

(2) "State archives" has the same meaning as described in section 11-1c of the general statutes.

(b) Notwithstanding any provision of the general statutes providing that a particular public record is confidential, and except as provided in subsection (c) of this section, any person may inspect any such record contained in the state archives if such record was created seventy-five years or more prior to the date of the request to inspect such record.

(c) Notwithstanding any provision of the general statutes providing that a particular public record is confidential, if the public record is contained in the state archives and relates to a natural person, any person may inspect such record if (1) such record was created seventy-five years or more prior to the date of the request to inspect such record, or (2) the date of the request to inspect such record occurs seventy-five years or more after the death of the person who is the subject of such record, whichever is later.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To require the preservation of records of historical value and to lift restrictions on access to public records contained in the state archives after a certain amount of time has passed.
