AN ACT EXPANDING HEALTH INSURANCE PRODUCTS AVAILABLE IN THIS STATE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective January 1, 2019) (a) For the purposes of this section:

(1) "Commissioner" means the Insurance Commissioner;

(2) "Health care provider" has the same meaning as provided in section 38a-477aa of the general statutes;

(3) "Health carrier" means an insurance company, health care center, hospital service corporation, medical service corporation, fraternal benefit society or other entity that delivers, issues for delivery, renews, amends or continues a health insurance policy in this state;

(4) "Health insurance policy" means an individual or group health insurance policy providing coverage of the type provided in subdivisions (1), (2), (4), (11), (12) and (16) of section 38a-469 of the general statutes;

(5) "Mandated health benefit" means a statutory obligation of a health carrier to (A) permit an insured or enrollee to obtain health care treatment or services from a particular type of health care provider, (B) offer or provide coverage for the screening, diagnosis or treatment of a particular disease or condition, or (C) offer or provide coverage for a particular type of health care treatment or service, or for medical equipment, medical supplies or drugs used in connection with a health care treatment or service;

(6) "Network" has the same meaning as provided in section 38a-472f of the general statutes;

(7) "Network plan" has the same meaning as provided in section 38a-472f of the general statutes;

(8) "Participating provider" has the same meaning as provided in section 38a-472f of the general statutes; and

(9) "Tiered network" has the same meaning as provided in section 38a-472f of the general statutes.

(b) Notwithstanding any provision of the general statutes, and to the extent permitted by federal law, a health carrier may deliver, issue for delivery, renew, amend or continue a health insurance policy in this state on or after January 1, 2019, that does not meet the requirements set forth in chapter 700c of the general statutes concerning mandated health benefits, network adequacy and tiered networks.

(c) The commissioner may adopt regulations, in accordance with chapter 54 of the general statutes, to implement this section.

This act shall take effect as follows and shall amend the following sections:
Section 1	January 1, 2019	New section

To expand the availability of health insurance products in this state.
