AN ACT CONCERNING THE DEFINITION OF "PHYSICALLY HELPLESS" WITH RESPECT TO SEXUAL ASSAULT OFFENSES.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That subdivision (6) of section 53a-65 of the general statutes be amended to redefine "physically helpless" with respect to sexual assault offenses to include a person with a severe physical or intellectual disability who cannot verbalize a lack of consent to sexual contact despite being conscious at the time of the sexual contact.
Statement of Purpose:
To redefine "physically helpless" with respect to sexual assault offenses to include a physical or intellectual disability that renders an individual unable to verbalize a lack of consent.
