Relative to Privacy Awareness Week.

SCR 44, Dodd. Privacy Awareness Week.
This measure would recognize the third week of May 2019, and the third week of May every year thereafter, as Privacy Awareness Week.

WHEREAS, Section 1 of Article 1 of the California Constitution establishes Californians’ inalienable right to privacy; and
WHEREAS, As the role of technology and data in the lives of consumers increases, there is an increase in the amount of personal information shared by consumers with businesses; and
WHEREAS, Many businesses collect and retain personal information from California consumers, including where a consumer lives, financial information, and social networks; and
WHEREAS, Data breaches have grown in scope and impact, and the disclosure of personal information can have devastating effects for individuals; and
WHEREAS, According to the Attorney General’s 2016 California Data Breach Report, the Attorney General received reports on 657 data breaches affecting more than 49 million records of Californians between 2012 and 2016; and
WHEREAS, Nationally, according to the Privacy Rights Clearinghouse, more than 11 billion records have been breached in more than 9,000 data breaches since 2005; and
WHEREAS, California was the first state to require consumer notification of personal information exposed as a result of a data breach; and
WHEREAS, Consumers should be aware of the risks to their privacy and the steps they can take to protect sensitive personal information; and
WHEREAS, Consumers should be aware of their rights under the California Consumer Privacy Act of 2018 to request information about a business’ privacy and data collection practices; and
WHEREAS, Consumers should be aware of the disclosure duties of businesses that collect a consumer’s personal information under the California Consumer Privacy Act of 2018; and
WHEREAS, Consumers should understand available resources for reporting identity theft and other privacy-related thefts and data breaches with the office of the Attorney General; now, therefore, be it
Resolved by the Senate of the State of California, the Assembly thereof concurring, That the Legislature recognizes the third week of May 2019, and the third week of May every year thereafter, as Privacy Awareness Week; and be it further
Resolved, That the Secretary of the Senate transmit copies of this resolution to the author for appropriate distribution.
