An act to add Section 25402.13 to the Public Resources Code, relating to energy.

SB 837, as amended, Archuleta. Energy: building energy standards: sealed and unvented attics.
Existing law requires the State Energy Resources Conservation and Development Commission to prescribe, by regulation, building design and construction standards and energy and water conservation design standards for new residential and nonresidential buildings to reduce wasteful, uneconomic, inefficient, and unnecessary consumption of energy and to manage energy loads to help maintain electrical grid reliability. Existing law requires the commission to periodically review the standards and adopt revisions that it deems necessary.
This bill would require the commission, in the review of those regulations that is pending as of January 1, 2024, to consider revising the definition of “conditioned space, indirectly” to include sealed and unvented attics, as provided.

The people of the State of California do enact as follows:


SECTION 1.

 Section 25402.13 is added to the Public Resources Code, to read:

25402.13.
 Beginning with the triennial review of Part 6 (commencing with Section 100.0) of Title 24 of the California Code of Regulations that is pending as of January 1, 2024, the commission shall consider revising the definition of “conditioned space, indirectly” for purposes of those regulations to include sealed and unvented attics, where the space is enclosed by the primary thermal and air barrier and directly adjoining conditioned space.
