An act to amend Section 33118 of the Education Code, relating to education finance. An act to add Article 12 (commencing with Section 79530) to Chapter 9 of Part 48 of Division 7 of Title 3 of the Education Code, relating to community colleges, and making an appropriation therefor.

Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. Existing law authorizes community college districts throughout the state to provide instruction at the campuses they operate.
This bill would establish the Los Angeles Community College District Small Business and Entrepreneurship Center at East Los Angeles College, and provide the mission and functions of the center, as specified. The bill would appropriate $2,500,000 from the General Fund in the 2023–24 fiscal year to the Los Angeles Community College District for the development and initial operation of the center. The bill would require, on or before January 1, 2028, the Los Angeles Community College District to prepare a summary report that includes an evaluation of the center in accomplishing the stated mission of the center, recommendations for improving programs offered by the center, and an accounting of the appropriated funds. By imposing new duties on a community college district, the bill would impose a state-mandated local program.
This bill would make legislative findings and declarations as to the necessity of a special statute for the Los Angeles Community College District.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

Existing law establishes a public school financing system that requires state funding for school districts, county offices of education, and charter schools to be calculated pursuant to a local control funding formula, as specified. Existing law requires the Superintendent of Public Instruction, by not later than July 25 each year, to prepare an estimate of the amount of state school money that will be apportioned to each county or city and county during the current school year, as provided.

This bill would instead require the Superintendent to prepare that estimate by July 31 each year, as provided.

The people of the State of California do enact as follows:


SECTION 1.

 (a) The Legislature finds and declares all of the following:
(1) California is the most populous state in the nation, with nearly 39.2 million residents and the third largest by area at approximately 163,696 square miles.
(2) The economy of California is the largest in the United States, with a $3.4 trillion gross state product as of 2022.
(3) If California were a sovereign nation, it would rank as the world’s fifth-largest economy as of 2022.
(4) California is home to 4.1 million small businesses, representing 99.8 percent of all businesses in the state and employing 7.2 million people or 48.5 percent of the private workforce.
(5) California businesses with fewer than 100 employees represent 97 percent of all businesses and employ nearly 36 percent of all workers. Businesses with fewer than 20 employees comprise more than 88 percent of all businesses, employing approximately 18.2 percent of all workers.
(6) An August 2020 Small Business Majority survey found that 44 percent of small businesses are at risk of shutting down.
(7) Data released through the census Current Population Survey found that minority-owned businesses are disproportionately impacted, the number of active businesses owned by African-Americans dropped by 41 percent, Latinx by 32 percent, Asians by 25 percent, and immigrants by 36 percent.
(8) The Greater Los Angeles area is the nation’s largest urban economy, with $1 trillion as of 2020.
(9) The County of Los Angeles is the most populous county in the United States, with 9,861,224 residents estimated as of 2022, and its population is greater than that of 40 individual states.
(10) The County of Los Angeles is home to over 250,000 local small businesses and nearly 1.1 million sole proprietors. These businesses account for 43 percent of the local workforce, making the County of Los Angeles the country’s largest small business economy.
(11) An estimated one-third of small businesses closed during the COVID-19 pandemic, thus supporting and strengthening existing businesses is critical.
(12) East Los Angeles College is strategically situated to help new business startups and support existing small businesses to revitalize the local and regional economy.
(b) It is the intent of the Legislature to establish the Los Angeles Community College District Small Business and Entrepreneurship Center at East Los Angeles College.

SEC. 2.

 Article 12 (commencing with Section 79530) is added to Chapter 9 of Part 48 of Division 7 of Title 3 of the Education Code, to read:
Article  12. Los Angeles Community College District Small Business and Entrepreneurship Center

79530.
 For purposes of this article, the following definitions apply:
(a) “Center” means the Small Business and Entrepreneurship Center.
(b) “District” means the Los Angeles Community College District.

79531.
 (a) The Los Angeles Community College District Small Business and Entrepreneurship Center is hereby established at East Los Angeles College.
(b) The mission of the center is to promote and support entrepreneurship education and microbusiness development at California Community Colleges and to support the growth and job-creation potential of regional small businesses through greater access to business education, mentors, and networking opportunities.
(c) The center shall do all of the following:
(1) Serve as a resource for the community through events and workshops on entrepreneurship education and access to small business development resources with the understanding that at its core, formal entrepreneurship training and access to entrepreneurship resources is an economic justice and equity issue.
(2) Build a clear management and entrepreneurship pathway that leads to high-demand certificates, degrees, careers, and business development opportunities.
(3) Enhance partnerships with business and nonprofit organizations that encourage the development of an entrepreneurship ecosystem for students to connect, both inside and outside the college environment.
(4) Establish student resources and support on campus to blend the importance of academic and entrepreneurial development.
(5) Partner with local, state, and federal governments, regional small businesses, and regional entities to support the local small business and entrepreneurial ecosystem.
(6) Develop and sustain an annual regional entrepreneurship and small business resource fair to impart technical assistance and essential business skills for business growth, management improvement, increased productivity, and innovation.
(7) Support local small businesses and entrepreneurs through startup microgrants, informational tools, networking and convening opportunities, and access to resources that enhance growth.
(8) Partner with existing technical assistance and entrepreneur development organizations, including the Los Angeles Area Chamber of Commerce and other public or private agencies that have a record of programming, workshops, and development programs.
(9) Manage center overhead and operational expenses, including website development, office furnishings, and product prototype equipment and materials.
(d) When building clear management and entrepreneurship pathways as referenced in paragraph (2) of subdivision (c), the center shall consult with relevant faculty and administrative groups of the California Community Colleges.

79532.
 (a) The sum of two million five hundred thousand dollars ($2,500,000) is hereby appropriated from the General Fund in the 2023–24 fiscal year to the district for the development and initial operation of the center.
(b) The money appropriated pursuant to subdivision (a) may be encumbered for up to a five-year period.
(c) The money appropriated pursuant to subdivision (a) may be used for any of the following purposes:
(1) To establish internships and work-study opportunities for students to engage in entrepreneurship resources, activities, and other learning opportunities.
(2) Student business and entrepreneur boot camps, workshops, seminars, annual business fairs, and membership subscriptions to business organizations that will provide discounted membership rates to participants and business incorporation fees as one-time business startup costs.
(3) Microgrants for underresourced, underrepresented, and disadvantaged students seeking to start or grow a microbusiness.
(4) To develop management and entrepreneurship education curricula for community colleges.
(5) Faculty professional development, faculty open education resource course development, and workshop material development.
(6) Business resource fairs to establish workforce and business partnerships to meet regional entrepreneurship needs.
(7) Outreach, recruitment, and marketing and branding materials.
(8) Guest speaker honoraria to serve as a resource for local and regional small businesses to enhance their productivity and growth.
(9) Staffing and startup operating costs for the center and the establishment of a small business regional advisory council.

 On or before January 1, 2028, the district shall prepare a summary report that includes an evaluation of the center in accomplishing the mission of the center as described in subdivision (c) of Section 79531, recommendations for improving programs offered by the center, and an accounting of how the funds appropriated in subdivision (a) of Section 79532 accomplished the purposes established in subdivision (c) of Section 79532.

SEC. 3.

 The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the unique need to establish the Los Angeles Community College District Small Business and Entrepreneurship Center at East Los Angeles College.

SEC. 4.

 If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
SECTION 1.Section 33118 of the Education Code is amended to read:
33118.

The Superintendent shall, by not later than July 31 each year, prepare an estimate of the amount of state school money that will be apportioned to each county or city and county during the current school year, and furnish a certified copy of the estimate to each county or city and county superintendent of schools.
