An act to amend Section 5009 of the Welfare and Institutions Code, relating to mental health.

SB 596, as introduced, Stern. Mental health.
Existing law, the Lanterman-Petris-Short Act, provides for the involuntary commitment and treatment of a person who is a danger to themselves or others or who is gravely disabled. Existing law requires a person who receives evaluation or treatment pursuant to the act to be given a choice of physician or other professional person providing those services, in accordance with the policies of each agency providing those services, and within the limits of available staff in the agency.
This bill would instead make that provision applicable to a person receiving both evaluation and treatment under the act.

The people of the State of California do enact as follows:


SECTION 1.

 Section 5009 of the Welfare and Institutions Code is amended to read:

5009.
 Persons receiving evaluation or and treatment under this part shall be given a choice of physician or other professional person providing such those services, in accordance with the policies of each agency providing services, and within the limits of available staff in the agency.
