An act to amend Section 27150 of of, and to add Section 38752 to, the Vehicle Code, relating to vehicles.

Existing law requires all vehicles subject to registration to be equipped with a muffler, as specified, to prevent excessive or unusual noise.
This bill would specify that electric vehicles are exempt from this requirement.
Existing law authorizes the operation of an autonomous vehicle on public roads for testing purposes by a driver who possesses the proper class of license for the type of vehicle being operated if specified requirements are met. Existing law defines “autonomous vehicle” for this purpose as a vehicle equipped with autonomous technology, as defined, that has been integrated into the vehicle. Existing regulations of the Department of Motor Vehicles prescribe requirements for testing autonomous vehicles that do not require a driver on public roads in California, including applying for and receiving a Manufacturer’s Testing Permit—Driverless Vehicles from the Department of Motor Vehicles, providing proof to the department of the manufacturer’s ability to respond to a judgment for damages up to $5,000,000, and providing written identification of an autonomous vehicle to the department.
This bill would exempt an autonomous vehicle that is designed to be operated exclusively and at all times by autonomous technology from any state law or regulation requiring the installation or maintenance of vehicle equipment that relates to or supports motor vehicle operation by a human driver, as specified.

The people of the State of California do enact as follows:


SECTION 1.

 Section 27150 of the Vehicle Code is amended to read:

27150.
 (a) Every motor vehicle subject to registration, except electric vehicles, shall at all times be equipped with an adequate muffler in constant operation and properly maintained to prevent any excessive or unusual noise, and no muffler or exhaust system shall be equipped with a cutout, bypass, or similar device.
(b) Except as provided in Division 16.5 (commencing with Section 38000) with respect to off-highway motor vehicles subject to identification, every passenger vehicle operated off the highways shall at all times be equipped with an adequate muffler in constant operation and properly maintained so as to meet the requirements of Article 2.5 (commencing with Section 27200), and no muffler or exhaust system shall be equipped with a cutout, bypass, or similar device.
(c) The provisions of subdivision (b) shall not be applicable to passenger vehicles being operated off the highways in an organized racing or competitive event conducted under the auspices of a recognized sanctioning body or by permit issued by the local governmental authority having jurisdiction.

SEC. 2.

 Section 38752 is added to the Vehicle Code, to read:

38752.
 An autonomous vehicle that is designed to be operated exclusively and at all times by autonomous technology, as defined in Section 38750, shall not be subject to any state law or regulation requiring the installation or maintenance of vehicle equipment that relates to or supports motor vehicle operation by a human driver, but is not necessary for operation by autonomous technology alone.
