Existing law makes it a felony to recklessly or maliciously have in a person’s possession any destructive device or explosive in specified places.
This bill would make a technical, nonsubstantive change to those provisions.

The people of the State of California do enact as follows:
SECTION 1.
The Legislature finds and declares all of the following:SEC. 2.
Section 23151 of the Revenue and Taxation Code is amended to read:23151.
(a) With the exception of banks and financial corporations, every corporation doing business within the limits of this state and not expressly exempted from taxation by the provisions of the Constitution of this state or by this part, shall annually pay to the state, for the privilege of exercising its corporate franchises within this state, a tax according to or measured by its net income, to be computed at the rate of 7.6 percent upon the basis of its net income for the next preceding income year, or if greater, the minimum tax specified in Section 23153.If the compensation ratio is: | The applicable tax rate is: |

Over 50 but not over 100 | 11.84% upon the basis of net income |
Over 100 but not over 200 | 12.84% upon the basis of net income |

Over 300 | 14.84% upon the basis of net income |
SEC. 3.
This act provides for a tax levy within the meaning of Article IV of the California Constitution and shall go into immediate effect.(a)Every person who recklessly or maliciously has in their possession any destructive device or any explosive in any of the following places is guilty of a felony:
(1)On a public street or highway.
(2)In or near any theater, hall, school, college, church, hotel, or other public building.
(3)In or near any private habitation.
(4)In, on, or near any aircraft, railway passenger train, car, cable road, cable car, or vessel engaged in carrying passengers for hire.
(5)In, on, or near any other public place ordinarily passed by human beings.
(b)An offense under subdivision (a) is punishable by imprisonment pursuant to subdivision (h) of Section 1170 for a period of two, four, or six years.
