An act to add Sections 7217 and 7231 Section 7210 to the Elections Code, relating to the Democratic Party of California.

SB 288, as amended, Wiener. Democratic Party of California: county central committee members and delegates to the state central committee. committees.
Existing law provides procedures for the election of members to county central committees of the Democratic Party. A county central committee must fill vacancies on the committee by appointment. A person is not eligible for appointment or election to a county central committee unless the person is registered as affiliated with the Democratic Party at the time of the person’s appointment or election. Existing law requires that a person’s political party preference be shown on the person’s affidavit of registration at the time the person registers to vote. The affidavit of registration must show the facts necessary to establish voter eligibility, including that the applicant is a United States citizen.
This bill would permit the appointment of a person who is not registered as affiliated with the Democratic Party to a county central committee, but only if permitted by the bylaws of that committee. It would also express the Legislature’s intent to enact legislation to permit a person who is not a United States citizen to be elected to and to serve as a member of a county central committee of the Democratic Party, if permitted by that county central committee.

Existing law does not expressly require that county central committee members or delegates to the state central committee of the Democratic Party of California be citizens of the United States. However, existing law provides that a person is not eligible for appointment or election to a county central committee who is not registered as affiliated with the Democratic Party at the time of the person’s appointment or election. Existing law requires that a person’s political party preference be shown on the person’s affidavit of registration at the time the person registers to vote. The affidavit of registration must show the facts necessary to establish voter eligibility, including that the applicant is a United States citizen.

This bill would allow, if the rules and bylaws of the Democratic Party so permit, a person who is not a United States citizen to serve as a member of a county central committee or as a delegate to the state central committee of the Democratic Party of California. This bill would also require, if the Democratic Party of California permits such a person to serve as a member of a county central committee or delegate, county central committees to permit such a person to serve in that capacity.

The people of the State of California do enact as follows:


SECTION 1.

 It is the intent of the Legislature to enact legislation to permit a person who is not a United States citizen to be elected to and to serve as a member of a county central committee of the Democratic Party, if permitted by that committee.

SEC. 2.

 Section 7210 is added to the Elections Code, to read:

7210.
 Notwithstanding Section 7209, a person who is not registered as affiliated with this party is eligible for appointment to a county central committee if such an appointment is permitted by the bylaws of that committee.

SECTION 1.Section 7217 is added to the Elections Code, to read:
7217.

Notwithstanding Section 7209 or any other law, a person who is not a United States citizen is eligible to serve as a member of a county central committee or as a delegate to the state central committee of the Democratic Party of California, provided that the rules and bylaws of the Democratic Party of California permit the person to serve in that capacity.

SEC. 2.Section 7231 is added to the Elections Code, to read:
7231.

Notwithstanding Section 7209 or any other law, if the rules and bylaws of the Democratic Party of California permit a person who is not a United States citizen to serve as a member of a county central committee or as a delegate to the state central committee of the Democratic Party of California, a county central committee shall also permit such a person to serve in that capacity.
