Carbon capture and storage pilot program: industrial facilities.
The California Global Warming Solutions Act of 2006 requires the State Air Resources Board to identify opportunities for greenhouse gas emission reduction measures, including carbon sequestration.
This bill would require the State Energy Resources Conservation and Development Commission, in consultation with various local, state, and federal agencies, including the state board, to establish a pilot program to encourage and expedite the design, construction, and operation of carbon capture and storage projects at industrial facilities in the state. As part of the pilot program, the bill would require the commission to establish a competitive grant program to provide funding, upon appropriation by the Legislature, to no more than 3 proposed projects for the design and construction of a carbon capture and storage project at
an industrial facility. The bill would require specified state agencies to provide permitting and technical support with regard to a proposed carbon capture and storage project to eligible applicants of the grant program and to entities that receive a grant under the grant program.

The people of the State of California do enact as follows:
SECTION 1.
Chapter 8.5 (commencing with Section 25730) is added to Division 15 of the Public Resources Code, to read:CHAPTER 8.5. Carbon Capture and Storage Pilot Program
25730.
For purposes of this chapter, the following definitions apply:(a) “Industrial facility” means an industrial facility, including, but not limited to, ethanol plants and thermal powerplants, that generates emissions of greenhouse gases.
(b) “Thermal powerplant” has the same meaning as in Section 25120, except is not limited with regard to the amount of electricity that can be produced at the facility.

The commission, in consultation with the Geologic Energy Management Division, the State Air Resources Board, the State Water Resources Control Board, the Public Utilities Commission, California Geological Survey, and any other relevant local, state, or federal agency, shall establish a pilot program to encourage and expedite the design, construction, and operation of carbon capture and storage projects at industrial facilities in the state.25732.
(a) As part of the pilot program, the commission shall establish a competitive grant program to provide funding, upon appropriation by the Legislature, to no more than three proposed projects for the design and construction of a carbon capture and storage project at an industrial facility.(b) An entity shall be eligible to submit an application for a grant pursuant to subdivision (a) only if both of the following requirements are met:
(1) The entity is the owner of the industrial facility.
(2) The proposed carbon capture and storage project will store the captured carbon at a high-quality geologic storage reservoir
that is colocated at the industrial facility.
(c) In selecting projects to be awarded grants pursuant to this chapter, the commission shall prioritize ethanol plants.
(d) As a condition of receiving a grant pursuant to this chapter, the owner of the industrial facility shall agree to do both of the following:
(1) Use the carbon that is stored as part of the project only for purposes of long-term storage and not for any other purpose, including, but not limited to, oil and gas recovery.
(2) Monitor and reduce criteria air pollutants emitted from the facility at a level determined by the commission.
