An act to add Section 49381 to the Education Code, relating to pupil safety.

SB 1104, as amended, Roth. Pupil safety: human trafficking prevention resources.

Existing law authorizes a school district to provide sexual abuse and sex trafficking prevention education, as defined, encourages school districts to collaborate with outside consultants, including law enforcement, with expertise in sexual abuse and sex trafficking prevention education in order to create school safety plans to address those threats, and authorizes in-service training of school district personnel relating to understanding sexual abuse and sex trafficking to be conducted periodically, as provided.

This bill would require a school district to work with the schools of the school district that maintain any of grades 6 to 12, inclusive, but no grade lower than grade 6, to identify the most appropriate methods of informing parents and guardians of pupils of human trafficking prevention resources and to implement the identified methods in those schools by an unspecified date. By imposing additional requirements on school districts, the bill would impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:

SECTION 1.

Section 49381 is added to the Education Code, to read:

49381.

A school district shall work with the schools of the school district that maintain any of grades 6 to 12, inclusive, but no grade lower than grade 6, to identify the most appropriate methods of informing parents and guardians of pupils of human trafficking prevention resources and shall implement the identified methods in those schools by ____.

SEC. 2.

If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
