AB 954, as amended, Petrie-Norris. Ocean use planning. City of Laguna Woods: leases: fire protection and public safety.
Existing law, the California Clean Water, Clean Air, and Safe Neighborhood Parks, and Coastal Protection Act of 2002, approved by the voters as Proposition 40 at the March 5, 2002, statewide primary election, authorizes the issuance of bonds in the amount of $2,600,000,000, for the purpose of financing a program for the acquisition, development, restoration, protection, rehabilitation, stabilization, reconstruction, preservation, and interpretation of park, coastal, agricultural land, air, and historical resources, as specified.
Existing law also authorizes the legislative body of any local agency to contract with any other local agency for the furnishing of fire or police protection to that other local agency.
This bill would authorize the City of Laguna Woods to lease to a public agency or joint powers authority, for purposes related to fire protection or public safety, the park property upon which improvements were made pursuant to specified grant agreements funded in accordance with the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002. The bill would require those leases to be subject to the requirements set forth in the grant contracts that are otherwise applicable to property sales or other dispositions.
This bill would make legislative findings and declarations as to the necessity of a special statute for the City of Laguna Woods.

Existing law requires the Secretary of the Natural Resources Agency to initiate a comprehensive, long-range planning process for the use of ocean waters offshore of California, and authorizes the secretary, among other things, to use a specified advisory panel as the planning committee.

This bill would make a nonsubstantive change to this provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 55633 is added to the Government Code, to read:

55633.
 The City of Laguna Woods may lease to a public agency or joint powers authority, for purposes related to fire protection or public safety, the park property upon which improvements were made pursuant to Grant Contract no. C0231065 and Grant Contract no. C0207295, funded in accordance with the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002 (Chapter 1.696 (commencing with Section 5096.600) of Division 5 of the Public Resources Code). Leases shall be subject to the requirements set forth in the grant contracts that are otherwise applicable to property sales or other dispositions.

SEC. 2.

 The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the unique need for public safety and fire protection facilities in the City of Laguna Woods.
SECTION 1.Section 30960 of the Public Resources Code is amended to read:
30960.

The Secretary of the Natural Resources Agency shall initiate a comprehensive, long-range planning process for the use of California’s offshore ocean waters, may use the advisory panel appointed pursuant to Section 6231 as the planning committee, and may use the California Sea Grant Program to promote sound scientific data analysis and assessment in this planning process.
