Prescription drugs.
Existing law, the Knox-Keene Health Care Service Plan Act of 1975 (Knox-Keene Act), provides for the licensure and regulation of health care service plans by the Department of Managed Health Care and makes a willful violation of the act a crime. Existing law also provides for the regulation of health insurers by the Department of Insurance. Existing law prohibits a nongrandfathered individual or group health care service plan or a health insurer that provides coverage for essential health benefits, as defined, from charging more than $250 in cost sharing for an individual, 30-day supply of a covered outpatient prescription drug, except as specified.
This bill would declare the intent of the Legislature to enact legislation that would address high prescription drug costs.
