An act relating to prescription drugs.

AB 904, as introduced, Gallagher. Prescription drugs.
Existing law, the Knox-Keene Health Care Service Plan Act of 1975 (Knox-Keene Act), provides for the licensure and regulation of health care service plans by the Department of Managed Health Care and makes a willful violation of the act a crime. Existing law also provides for the regulation of health insurers by the Department of Insurance. Existing law prohibits a nongrandfathered individual or group health care service plan or a health insurer that provides coverage for essential health benefits, as defined, from charging more than $250 in cost sharing for an individual, 30-day supply of a covered outpatient prescription drug, except as specified.
This bill would declare the intent of the Legislature to enact legislation that would address high prescription drug costs.

SECTION 1.

 It is the intent of the Legislature to enact legislation that would address high prescription drug costs.
