An act to amend Section Sections 14978.1 and 52286 of the Food and Agricultural Code, relating to commercial feed. food and agriculture.

Existing

(1) Existing law establishes the Feed Inspection Advisory Board in state government and generally requires it to serve in an advisory capacity to the Secretary of Food and Agriculture with respect to the operation of the law governing commercial feed. Existing law authorizes the advisory board to establish or designate one or more other entities to administer all or part of the law governing commercial feed and requires the secretary to adopt regulations and procedures to be used by the entity or entities. Existing law specifies the entity or entities that may be established or designated by the advisory board for this purpose including state accredited or certified chemistry laboratories.
This bill would expand the types of entities that may be established or designated for this purpose to include any state accredited, certified, or licensed laboratories.
(2) The California Seed Law regulates seed sold in California, and requires the Secretary of Food and Agriculture to maintain a properly equipped laboratory for examining and testing seeds.
This bill would instead authorize the secretary to maintain a properly equipped laboratory for examining and testing seeds for the purpose of enforcing the germination and purity standards established by the California Seed Law. The bill would authorize the secretary to approve laboratories to conduct germination and purity examinations and testing of seeds that meet specified requirements.

The people of the State of California do enact as follows:


SECTION 1.

 Section 14978.1 of the Food and Agricultural Code is amended to read:

14978.1.
 (a) The entity or entities that may be established or designated by the board pursuant to Section 14978 includes, but shall not be limited to, the following:
(1) The committee established pursuant to Section 14978.2.
(2) Agricultural councils, commissions, and any entity established in accordance with a marketing order.
(3) Federal, state, or county agencies.
(4) The University of California and cooperative extension service.
(5) Agricultural associations and cooperatives.
(6) State accredited, certified, or licensed laboratories.
(b) The board may not designate any entity pursuant to Section 14978 that is a trade association whose membership is composed primarily of persons licensed under this chapter or that represents persons regulated by this chapter.

SEC. 2.

 Section 52286 of the Food and Agricultural Code is amended to read:

52286.
 (a) The director shall secretary may maintain a properly equipped laboratory for examining and testing seeds. seeds for the purpose of enforcing the germination and purity standards established by this chapter.
(b) The secretary may approve laboratories to conduct germination and purity examinations and testing of seeds that meet all of the following requirements:
(1) Are accredited under the International Organization for Standardization (ISO)/International Electrotechnical Commission (IEC) 17025 standard.
(2) Conduct examination, testing, and reporting in accordance with rules, methods, and standards approved by the Association of Official Seed Analysts or the International Seed Testing Association.
(3) Conduct examination, testing, and reporting by a seed technologist registered by the Society of Commercial Seed Technologists.
