An act to amend Section 374 of the Financial Code, relating to financial institutions.

AB 406, as introduced, Chen. Department of Financial Protection and Innovation: document charges.
Existing law, the Financial Institutions Law, regulates the activities of various financial entities, including commercial banks, industrial banks, trust companies, credit unions, and savings associations. Existing law establishes the Department of Financial Protection and Innovation, which is under the direction of the Commissioner of Financial Protection and Innovation, and is responsible for the administration and enforcement of the Financial Institutions Law.
Existing law authorizes the commissioner to charge a maximum of $0.25 for each page copied when the department is required to furnish a copy of a filed paper, as prescribed.
This bill would, instead, authorize the commissioner to charge no more than $0.10 for each page copied.

The people of the State of California do enact as follows:


SECTION 1.

 Section 374 of the Financial Code is amended to read:

374.
 (a) Whenever it is necessary for the commissioner to approve any instrument and to affix his or her the commissioner’s official seal thereto, the commissioner shall charge a fee of twenty-five dollars ($25) therefor.
(b) Whenever it is proper for the department to furnish a copy of any paper that has been filed therein and to certify to the paper, the commissioner may charge twenty-five cents ($0.25) no more than ten cents ($0.10) for each page copied.
(c) Whenever the commissioner is required or requested to certify copies of documents, the commissioner may charge a fee of twenty-five dollars ($25) for certifying the copied documents and for affixing his or her the commissioner’s official seal.
