An act to add Section 44013 to the Public Resources Code, and to add Section 751 to the Public Utilities Code, relating to energy. biomethane.

AB 3187, as amended, Grayson.
Biomethane. Biomethane: solid waste facility permits: gas corporations: rates: interconnection.
Existing law requires the Department of Resources Recycling and Recovery to identify and recommend actions to address permitting and siting challenges associated with composting and anaerobic digestion and to encourage the continued viability of the state’s organic waste processing and recycling infrastructure, in partnership with the California Environmental Protection Agency and other specified state and regional agencies.
This bill would require the department to streamline the permitting process for anaerobic digestion facilities to allow holders of solid waste facility permits to modify those permits to include anaerobic digestion
facilities.
Under existing law, the Public Utilities Commission has regulatory authority over public utilities, including gas corporations. Existing law authorizes the commission to fix the rates and charges for every public utility and requires that those rates and charges be just and reasonable. Existing law requires the commission to adopt policies and programs that promote the in-state production and distribution of biomethane, as defined, that facilitate the development of a variety of sources of in-state biomethane.
This bill would state the intent of the Legislature to enact legislation establishing goals for the procurement of biomethane.

The people of the State of California do enact as follows:
SECTION 1.
Section 44013 is added to the Public Resources Code, to read:44013.
The board shall streamline the permitting process for an anaerobic digestion facility to allow a holder of a solid waste facility permit to modify that permit to include an anaerobic digestion facility.SEC. 2.
Section 751 is added to the Public Utilities Code, to read:751.
The commission shall authorize a gas corporation to include in its rate base all reasonable costs incurred to interconnect a biomass conversion facility or anaerobic digestion facility to its common carrier pipeline.It is the intent of the Legislature to enact legislation establishing goals for the procurement of biomethane.
