An act to amend Section 11911 of the Food and Agricultural Code, relating to pest control.

AB 2997, as introduced, Quirk-Silva. Pest control: aircraft operations.
Existing law provides that it is unlawful for any person to operate a manned aircraft in pest control unless the pilot operating the aircraft holds a valid manned pest control aircraft pilot’s certificate issued by the Director of Pesticide Regulation and an appropriate and valid commercial pilot’s certificate and a current appropriate medical certificate issued by the Federal Aviation Administration. Existing law also provides that if the holder of a certificate is called to active duty as a member of the Armed Forces of the United States of America, the holder, upon the termination of such active duty, is entitled to renewal of such certificate in the same category, if he or she does all 3 specified actions, including, among other things, that he or she demonstrates to the director the ability to conduct pest control operations and his or her knowledge of the nature and effect of materials which are used in pest control.
This bill would instead provide that if the holder of a certificate is called to active duty as a member of the Armed Forces of the United States of America, the holder, upon the termination of that active military duty, is entitled to reinstatement of the certificate in the same category if he or she does the 3 required actions.

The people of the State of California do enact as follows:


SECTION 1.

 Section 11911 of the Food and Agricultural Code is amended to read:

11911.
 Notwithstanding any other provision of this article, if the holder of a certificate is called to active duty as a member of the armed forces Armed Forces of the United States of America, the holder, upon the termination of such that active military duty, is entitled to renewal reinstatement of such the certificate in the same category, if he or she does all of the following:
(a) Makes application to the director.
(b) Pays the renewal fee required by the director.
(c) Demonstrates to the director his the ability to conduct pest control operations and his or her knowledge of the nature and effect of materials which that are used in pest control.
