An act to add Section 38511 to the Health and Safety Code, relating to greenhouse gases.

AB 2726, as amended, Levine. California Global Warming Solutions Act of 2006: consumption-based accounting.
The California Global Warming Solutions Act of 2006 designates the State Air Resources Board as the state agency charged with monitoring and regulating sources of emissions of greenhouse gases.
This bill would require the state board to establish and maintain an inventory of emissions of greenhouse gases on a consumption-based accounting basis, as specified.

The people of the State of California do enact as follows:


SECTION 1.

 (a) The Legislature finds and declares that recent academic studies have shown that measures of carbon dioxide accounting differ substantially when computed on a consumption basis, which takes into account emissions of greenhouse gases associated with products consumed within a region rather than on a production basis, giving a more accurate picture of a region’s contribution to the emissions of greenhouse gases.
(b) (1) It is the intent of the Legislature to provide the state with a more accurate picture of emissions of greenhouse gases attributable to California by requiring the State Air Resources Board to establish and update an inventory of emissions of greenhouse gases on a consumption-based accounting basis.
(2) It is not the intent of the Legislature to require the use of the consumption-based accounting basis to establish the statewide greenhouse gas emissions limits pursuant to the California Global Warming Solutions Act of 2006 (Division 25.5 (commencing with Section 38500) of the Health and Safety Code) or any enforceable standards for emissions of greenhouse gases.

SEC. 2.

 Section 38511 is added to the Health and Safety Code, to read:

38511.
 (a) To provide the state with more accurate information on the state’s effort in reducing its contribution to the global emissions of greenhouse gases, the state board shall establish, and update every three years, an inventory of emissions of greenhouse gases on a consumption-based accounting basis that accounts for emissions of greenhouse gases associated with products consumed within the state and excludes emissions of greenhouse gases associated with products produced in the state that are consumed outside the state.
(b) The state board shall not use the inventory of greenhouse gas emissions required pursuant to subdivision (a) for the purposes of subdivision (c) of Section 38562. any of the following:
(1) Subdivision (c) of Section 38562.
(2) Section 398.4 of the Public Utilities Code.
(3) For any purpose relating to ensuring compliance with Section 399.15 or Section 454.52 of the Public Utilities Code.
