An act to add Section 18999.83 to the Welfare and Institutions Code, relating to homelessness.

Existing law authorizes a county to establish a homeless adult and family multidisciplinary personnel team, as defined, with the goal of facilitating the expedited identification, assessment, and linkage of homeless individuals to housing and supportive services within that county and to allow provider agencies to share confidential information for the purpose of coordinating housing and supportive services to ensure continuity of care. Existing law requires this sharing of information to be governed by protocols developed in each county describing how and what information may be shared by the homeless adult and family multidisciplinary personnel team to ensure that confidential information gathered by the team is not disclosed in violation of state or federal law, and requires a copy of the protocols to
be distributed to each participating agency and persons and the State Department of Social Services.
This bill would express the intent of the Legislature to enact legislation that would create a regional pilot program in the Counties of Los Angeles, Santa Barbara, and Ventura to authorize the sharing of mental health records of homeless individuals.
This bill would authorize a county that has established a homeless adult and family multidisciplinary personnel team to enter into an agreement with surrounding counties that have also established a homeless adult and family multidisciplinary personnel team to share confidential information for the purpose of coordinating housing and supportive
services to ensure continuity of care across county lines. The bill would similarly require the participating counties to jointly develop protocols and to distribute the protocols as described above.

The people of the State of California do enact as follows:
SECTION 1.
Section 18999.83 is added to the Welfare and Institutions Code, to read:18999.83.
(a) A county that has established a homeless adult and family multidisciplinary personnel team established pursuant to Section 18999.8 may enter into an agreement with surrounding counties that have also established a homeless adult and family multidisciplinary personnel team to share confidential information for the purpose of coordinating housing and supportive services to ensure continuity of care across county lines.(b) (1) Counties that enter an agreement pursuant to this section shall jointly develop protocols describing how and what information may be shared by the homeless adult and family multidisciplinary personnel teams in each participating county to ensure that confidential information gathered and
shared by the teams is not disclosed in violation of state or federal law.
(2) A copy of the protocols shall be distributed to homeless service provider agencies and persons in those agencies who participate in a participating county’s homeless adult and family multidisciplinary personnel team, and shall be posted on each participating county’s internet website on the homepage of the county’s office of homelessness, social services department, or human services agency within 30 days of adoption. A copy of the protocols shall be provided to the State Department of Social Services. This paragraph does not require the department to review or approve any protocols that it receives.
It is the intent of the Legislature to enact legislation that would create a regional pilot program in the Counties of Los Angeles, Santa Barbara, and Ventura to authorize the sharing of mental health records of homeless individuals.
