An act to add and repeal Section 12807.7 to of the Government Code, and to add and repeal Section 189.6 to of the Water Code, relating to resource conservation.

AB 2519, as amended, Wood. Conservation projects: grants: advance payments.

Existing law establishes in state government the Natural Resources Agency. Existing law establishes in the Natural Resources Agency the State Coastal Conservancy and the Department of Water Resources. Existing law establishes in the California Environmental Protection Agency the State Water Resources Control Board. Existing law requires the Natural Resources Agency, the conservancy, the department, and the board to administer various grant programs relating to natural resources.

This bill, until January 1, 2025, would require, to the extent not in conflict with any other law, the Natural Resources Agency, the conservancy, the department, and the board, when awarding grants for conservation projects, as defined, to provide an advance payment of up to 25% of the total grant award if requested by a grant ~~recipient.~~ recipient, as provided. The bill would require, on or before January 15 of each year, the granting entities specified above to provide a report to the Legislature, as part of the annual budget process, on the outcome of the use of the advance payments.

The people of the State of California do enact as follows:

SECTION 1.

Section 12807.7 is added to the Government Code, to read:

12807.7.

(a) To the extent not in conflict with any other law, the Natural Resources Agency, including the State Coastal Conservancy and the Department of Water Resources within the agency, when awarding grants for conservation projects, shall provide an advance payment of up to 25 percent of the total grant award if requested by a grant recipient.

(b) (1) An advance payment made pursuant to subdivision (a) shall be deposited into a non-interest-bearing account.
(2) The grantee shall expend the funds from the advance payment within six months of receipt, unless the granting entity waives this requirement.
(3) The grantee shall file an accountability report with the granting entity four months from the date of receiving the advance payment funds.
(c) (1) On or before January 15 of each year, the granting entity shall provide a report to the Legislature, as part of the annual budget process, on the outcome of the use of the advance payments provided pursuant to this section.
(2) A report submitted pursuant to this subdivision shall be submitted pursuant to Section 9795.

(d) For purposes of this section, “conservation project” means a conservation project that enhances climate resilience, restores watersheds, or protects and preserves natural lands.

(e) This section shall remain in effect only until January 1, 2025, and as of that date is repealed, unless a later enacted statute that is enacted before January 1, 2025, deletes or extends that date.

SEC. 2.

Section 189.6 is added to the Water Code, immediately following Section 189.5, to read:

189.6.

(a) To the extent not in conflict with any other law, the board, when awarding grants for water conservation projects, shall provide an advance payment of up to 25 percent of the total grant award if requested by a grant recipient.

(b) (1) An advance payment made pursuant to subdivision (a) shall be deposited into a non-interest-bearing account.
(2) The grantee shall expend the funds from the advance payment within six months of receipt, unless the board waives this requirement.
(3) The grantee shall file an accountability report with the board four months from the date of receiving the advance payment funds.
(c) (1) On or before January 15 of each year, the board shall provide a report to the Legislature, as part of the annual budget process, on the outcome of the use of the advance payments provided pursuant to this section.
(2) A report submitted pursuant to this subdivision shall be submitted pursuant to Section 9795 of the Government Code.
