An act to add Section 89700.2 to the Education Code, relating to public postsecondary education.

Public postsecondary education: California State University: tuition.
Existing law establishes the California State University, under the administration of the Trustees of the California State University, as one of the segments of public postsecondary education in this state. The California State University comprises 23 institutions of higher education located throughout the state. Existing law authorizes the trustees to require the payment of fees, rents, deposits, and charges for services, facilities, or materials provided by the trustees. Existing law establishes the California Promise, which requires at least 20 individual campuses of the California State University to establish a California Promise program through which each campus would enter into a pledge with a student who satisfies specified criteria to support the student in earning a baccalaureate degree in limited time.
This bill would prohibit the
charging of tuition or mandatory systemwide fees for enrollment at a campus of the California State University for any academic year, for up to 2 academic years, to a California Community College resident transfer student who has completed an associate degree for transfer and has received a fee waiver, as provided. Upon the enactment of an appropriation for this purpose, the bill would require the Chancellor of the California State University to distribute funding to each California State University campus to offset the costs of waiving tuition and mandatory systemwide fees to transfer students pursuant to this bill. The bill would make implementation of its provisions contingent upon the enactment of an appropriation for its purposes.

The people of the State of California do enact as follows:
SECTION 1.
Section 89700.2 is added to the Education Code, to read:89700.2.
(a) The California State University shall not charge tuition or mandatory systemwide fees for enrollment at a campus of the university for any academic year, for up to two academic years, to a California Community College transfer student who has satisfied both of the following:(1) The student has completed an associate degree for transfer.
(2) The student has received a fee waiver pursuant to subdivision (b) of Section 76396.3 or Section 76300.
(b) Upon the enactment of an appropriation for this purpose, the chancellor shall distribute funding to each California State University campus to offset the costs of
waiving tuition and mandatory systemwide fees pursuant to subdivision (a). It is the intent of the Legislature that sufficient funding be allocated to each participating campus to offset the cost of all tuition and mandatory systemwide fee waivers granted pursuant to subdivision (a).
(c) (1) The California State University shall waive tuition and mandatory systemwide fees pursuant to this section in a manner that supplements, does not supplant, and maximizes, student access to institutional and need-based financial aid. Students who qualify to have their tuition and mandatory systemwide fees waived under this section, have financial need, and have all or a portion of their tuition and mandatory systemwide fees waived by other financial aid programs shall receive a grant in the amount of tuition and fees that would have otherwise been waived pursuant to subdivision (a) to help cover their nontuition college costs.
(2) The California State University shall ensure that qualifying students, as a condition of having tuition and mandatory fees waived pursuant to this section, complete the Free Application for Federal Student Aid, application for a state university grant, or California Dream Act application.
(3) As used in this subdivision, “institutional financial aid” means financial aid that is paid for by the California State University from its funds and the recipient of which is selected by the California State University.
(d) The Legislature finds and declares, within the meaning of subsection (d) of Section 1621 of Title 8 of the United States Code, that undocumented persons who complete and submit the California Dream Act application and meet the requirements of subdivision (a) shall be eligible to have their tuition and
mandatory systemwide fees waived under this section.
(e) This section shall be implemented only upon the enactment of an appropriation for its purposes.
