An act to amend Section 99250 of add Section 99253 to the Education Code, relating to postsecondary education.

Existing law establishes the University of California, under the administration of the Regents of the University of California, and the California State University, under the administration of the Trustees of the California State University, the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, independent institutions of higher education, and private postsecondary educational institutions University as 2 of the segments of public postsecondary education in this state. Many institutions in these segments offer health care services to their students.
This bill would make a nonsubstantive change in a provision related to student health care services in postsecondary education. require the student health centers of all campuses of the University of California and the California State University to have HIV postexposure prophylaxis (PEP), as defined, on hand and readily available to dispense to students in need, upon required consultation and exams, at low or no cost to a student, as specified. The bill would also require those student health centers to provide preexposure prophylaxis (PrEP), as defined, to students in need as soon as possible or within 15 calendar days of a request. The bill would also provide, as an alternative to directly providing PrEP or PEP to a student in need, authorize a campus to help the student navigate the process of obtaining PrEP or PEP through the student’s insurance or through other resources, while offering to coordinate the student’s transportation, at no cost to the student, to any necessary consultations, to pick up the medication, and to engage in followup care with the student’s provider if it is located off campus.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares both of the following:
(a) The federal Centers for Disease Control and Prevention (CDC) found that in 2016, young adults between 13 and 24 years of age accounted for 21 percent of new HIV infections in the United States, and 17 percent of new infections occurred in adults between 20 and 24 years of age.
(b) Expanding and ensuring access to preexposure prophylaxis and postexposure prophylaxis is critical in achieving California’s goal of getting to zero: zero transmission, zero HIV-related deaths, and zero HIV stigma.

SEC. 2.

 Section 99253 is added to the Education Code, immediately following Section 99251, to read:

99253.
 (a) The student health centers of all campuses of the University of California and the California State University shall do both of the following:
(1) Have HIV postexposure prophylaxis (PEP) on hand and readily available to dispense. These student health centers shall be able to dispense PEP immediately to a student in need, upon required consultation and exams. The PEP shall be provided at low or no cost to the student. If PEP is to be dispensed to a student pursuant to the alternative set forth in subdivision (b), it shall be made available to the student in less than 24 hours.
(2) Provide preexposure prophylaxis (PrEP). These student health centers shall provide PrEP to students in need as soon as possible or within 15 calendar days of a request.
(b) A student health center or campus of the University of California or the California State University may, as an alternative to directly providing PrEP or PEP to a student in need, help the student navigate the process of obtaining PrEP or PEP through the student’s insurance or through other resources, such as a grant-based program or through a telehealth service, so long as the student is able to complete the necessary consultations and obtain PrEP within 15 days. The student health center shall offer to coordinate transportation, at no cost to the student, to any necessary consultations, to pick up the medication, and to engage in follow-up care with the student’s provider if that provider is located off-campus.
(c) As used in this section:
(1) “CDC guidelines” means:
(A) With respect to PEP, the “Updated Guidelines for Antiretroviral Postexposure Prophylaxis After Sexual, Injection Drug Use, or Other Nonoccupational Exposure to HIV–United States, 2016,” or any subsequent guidelines, published by the federal Centers for Disease Control and Prevention.
(B) With respect to PrEP, the “2017 Preexposure Prophylaxis for the Prevention of HIV Infection in the United States – 2017 Update: A Clinical Practice Guideline,” or any subsequent guidelines, published by the federal Centers for Disease Control.
(2) “Postexposure prophylaxis” (PEP) means any of the following:
(A) Tenofovir disoproxil fumarate (TDF) (300 mg) with emtricitabine (FTC) (200 mg), taken once daily, in combination with either raltegravir (400 mg), taken twice daily, or dolutegravir (50 mg), taken once daily.
(B) Tenofovir disoproxil fumarate (TDF) (300 mg) and emtricitabine (FTC) (200 mg), taken once daily, in combination with darunavir (800 mg) and ritonavir (100 mg), taken once daily.
(C) Another drug or drug combination determined by the California State Board of Pharmacy to meet the same clinical eligibility recommendations provided in CDC guidelines.
(3) “Preexposure prophylaxis” (PrEP) means a fixed-dose combination of tenofovir disoproxil fumarate (TDF) (300 mg) with emtricitabine (FTC) (200 mg), or another drug or drug combination determined by the California State Board of Pharmacy to meet the same clinical eligibility recommendations provided in CDC guidelines.

SECTION 1.Section 99250 of the Education Code is amended to read:
99250.

For purposes of this chapter, the following definitions apply:

(a)“Commission” means the Commission on the Status of Women and Girls established by Section 8241 of the Government Code.

(b)“Fund” means the College Student Health Center Sexual and Reproductive Health Preparation Fund established by Section 99251.

(c)“Grantee” means any qualifying student health center at a public college or university.

(d)“Medication abortion readiness” includes, but is not limited to, assessment of each individual clinic to determine facility and training needs before beginning to provide abortion by medication techniques, purchasing equipment, making facility improvements, establishing clinical protocols, creating patient educational materials, and training staff. “Medication abortion readiness” does not include the provision of abortion by medication techniques.

(e)“Public university student health center” means a clinic providing primary health care services to students that is located on the campus of a university within the University of California or California State University systems.

(f)“Public university system” means the University of California or the California State University.
