An act relating to the California Victim Compensation Board, state claims, making an appropriation therefor, and declaring the urgency thereof, to take effect immediately.

Existing law generally provides for the reimbursement of victims and derivative victims of specified types of crimes by the California Victim Compensation Board from the Restitution Fund, a continuously appropriated fund, for specified losses suffered as a result of those crimes. Existing law sets forth eligibility requirements and limits on the amount of compensation the board may award, and requires the application for compensation to be verified under penalty of perjury.

This bill would state the intent of the Legislature to appropriate funds for the payment of claims against the state approved by the California Victim Compensation Board.

This bill would declare that it is to take effect immediately as an urgency statute.

Existing law requires the California Victim Compensation Board, in cases in which evidence shows that a crime with which a claimant was charged was either not committed at all, or not committed by the claimant, to report the facts of the case and its conclusions to the Legislature with a recommendation that the Legislature make an appropriation for the purpose of indemnifying the claimant for the injury.

This bill would appropriate specified sums from the General Fund to the executive officer of the board for the payment of the claims of specified individuals.

This bill would declare that it is to take effect immediately as an urgency statute.

Bill Text

The people of the State of California do enact as follows:

It is the intent of the Legislature to appropriate funds for the payment of claims against the state approved by the California Victim Compensation Board.

SECTION 1.

 The sum of three hundred forty thousand six hundred twenty dollars ($340,620) is hereby appropriated from the General Fund to the Executive Officer of the California Victim Compensation Board for the payment of the claim of Reggie Cole, accepted by the board and reported to the Legislature pursuant to Section 4904 of the Penal Code.

SEC. 2.

 The sum of one million seven hundred thirty-nine thousand seven hundred eighty dollars ($1,739,780) is hereby appropriated from the General Fund to the Executive Officer of the California Victim Compensation Board for the payment of the claim of Kash Register, accepted by the board and reported to the Legislature pursuant to Section 4904 of the Penal Code.

SEC. 3.

 The sum of eight hundred eighty-six thousand seven hundred sixty dollars ($886,760) is hereby appropriated from the General Fund to the Executive Officer of the California Victim Compensation Board for the payment of the claim of Luis Vargas, accepted by the board and reported to the Legislature pursuant to Section 4904 of the Penal Code.

SEC. 2.SEC. 4.

 This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the California Constitution and shall go into immediate effect. The facts constituting the necessity are:

In order to pay claims against the state and end hardship to claimants as quickly as possible, it is necessary that this act take effect immediately.
