An act to amend Section 30050 of the Streets and Highways Code, relating to transportation. An act to add Section 39730.9 to the Health and Safety Code, relating to greenhouse gases.

AB 1970, as amended, Eduardo Garcia. California Toll Bridge Authority Act. Low-carbon fuels.
Existing law requires the State Air Resources Board to approve and implement a comprehensive strategy to reduce emissions of short-lived climate pollutants to achieve a reduction in methane by 40% below 2013 levels by 2030. Existing law requires the state board, in consultation with the Department of Food and Agriculture, to adopt regulations to reduce methane emissions from livestock manure management operations and dairy manure management operations, as specified. Existing law requires the state board, the Public Utilities Commission, and the State Energy Resources Conservation and Development Commission to undertake various actions related to reducing short-lived climate pollutants in the state. Existing law requires the Department of Resources Recycling and Recovery, in consultation with the state board, to achieve specified targets for reducing organic waste in landfills.
This bill would require the state board, the State Energy Resources Conservation and Development Commission, the Department of Resources Recycling and Recovery, and the Department of Food and Agriculture to allocate an unspecified percentage of moneys for fuels and methane mitigation appropriated by the Legislature to those agencies for the development of innovative low-carbon fuels.

Existing law, the California Toll Bridge Authority Act, abolished the California Toll Bridge Authority and vested the California Transportation Commission with the authority’s duties, powers, purposes, responsibilities, and jurisdiction. The act provides that the California Transportation Commission has the possession and control of all licenses, permits, leases, agreements, contracts, orders, claims, judgments, records, papers, equipment, supplies, bonds, moneys, funds, appropriations, buildings, land, and other property held for the benefit, use, or obligation of the California Toll Bridge Authority.

This bill would make a nonsubstantive change to these provisions.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares all of the following:
(a) California has dedicated significant funding to the development of low-carbon fuels.
(b) The development of low-carbon fuels has significant benefits for the transportation and energy sectors, which collectively contributed over one-half of California’s emission of greenhouse gases in 2015, as well as significant cobenefits for communities across the state that see new jobs and reduced exposure to harmful copollutants.
(c) California’s low-carbon fuel standards created a global model for reducing the carbon intensity of fuels.
(d) California’s short-lived climate pollutant strategy requires methane mitigation from multiple sources across the state, most of which results in the production of renewable gas.
(e) While it is important to displace the demand for conventional fuels, the Legislature also believes that development of new technologies is an important contribution California can and should make to facilitate emissions reductions here and around the world.

SEC. 2.

 Section 39730.9 is added to the Health and Safety Code, to read:

39730.9.
 The state board, the State Energy Resources Conservation and Development Commission, the Department of Resources Recycling and Recovery, and the Department of Food and Agriculture shall allocate ____ percent of moneys for fuels and methane mitigation appropriated by the Legislature to those agencies for the development of innovative low-carbon fuels.

SECTION 1.Section 30050 of the Streets and Highways Code is amended to read:
30050.

(a)The California Toll Bridge Authority is hereby abolished, and the California Transportation Commission succeeds to, and is vested with, the duties, powers, purposes, responsibilities, and jurisdiction of the California Toll Bridge Authority.

(b)Any reference in any law or regulation to the California Toll Bridge Authority shall be deemed to refer to the California Transportation Commission.

(c)The California Transportation Commission shall have the possession and control of all licenses, permits, leases, agreements, contracts, orders, claims, judgments, records, papers, equipment, supplies, bonds, moneys, funds, appropriations, buildings, land, and other property, real or personal, held for the benefit, use, or obligation of the California Toll Bridge Authority.
