An act to repeal Article 4 (commencing with Section 33550) of Chapter 4 of Part 20 of Division 2 of Title 2 of the Education Code, relating to education governance. relating to elementary and secondary education.

Existing law requires the State Board of Education to adopt basic instructional materials for use in kindergarten and grades 1 to 8, inclusive, for governing boards of school districts in specified subjects and any other subject, discipline, or interdisciplinary area for which the state board determines the adoption of instructional materials to be necessary or desirable; and requires the governing board of each school district maintaining one or more high schools to adopt instructional materials for use in the high schools under its control, consistent with specified conditions. Existing law authorizes a local educational agency to use instructional materials that are aligned with the academic content standards, including instructional materials that have not been adopted by the state board.
Existing law requires the governing board of a school district, when adopting instructional materials for use in schools, to include only instructional materials that meet certain content requirements, including a requirement that, in the determination of the governing board, the instructional materials accurately portray the cultural and racial diversity of our society.
This bill would require the Superintendent of Public Instruction, subject to an appropriation of one-time funds for this purpose in the Budget Act or another statute, to allocate funding for the purchase of standards-aligned instructional materials in visual and performing arts and world languages in kindergarten and grades 1 to 12, inclusive, and for professional development in those subjects, as provided. The bill would state the intent of the Legislature that these materials and professional learning opportunities reflect the cultural diversity of the state
and of the world, consistent with state law, and that the professional learning opportunities be of high quality. The bill would include related legislative findings and declarations.
Existing law establishes a system of public elementary and secondary education in this state. Under this system, local educational agencies throughout the state provide instruction and other services to pupils in kindergarten and in grades 1 to 12, inclusive. Existing law establishes various state commissions and committees with responsibilities relating to this system, including the Educational Management and Evaluation Commission. Existing law establishes the commission to assist and advise the State Board of Education in the evaluation of the program achievement of educational programs, in the determination of the relative cost-effectiveness of educational programs, and in the making of recommendations concerning the expanded use, modification, or replacement of educational programs so as to produce a higher degree of program achievement and cost-effectiveness.
This bill would eliminate the commission.

The people of the State of California do enact as follows:
SECTION 1.
The Legislature finds and declares all of the following:(a) Visual and performing arts and world languages are vital subjects of study for California pupils. These subjects are included in the state’s graduation requirements and in eligibility standards for admission to the University of California and the California State University, and are important elements of college and career readiness. Skills in these subjects are also widely recognized as valuable in employment.
(b) Revised content standards in visual and
performing arts and world languages were adopted by the state board in 2019, revised curriculum frameworks were adopted by the state board in 2020, and instructional materials for kindergarten and grades 1 to 8, inclusive, were adopted by the state board in 2021.
(c) After previous adoptions of revised content standards in mathematics, English language arts, and science, the state appropriated funding to assist local educational agencies in the purchase of standards-aligned instructional materials and for associated professional development. These investments supported local adoption of new content standards in those areas by making instructional materials available for students and training on the new standards available to teachers and other school staff.
(d) A similar investment is needed to ensure that California students and teachers have access to high-quality
standards-aligned instruction and instructional materials in visual and performing arts and world languages.
SEC. 2.
(a) Subject to an appropriation of one-time funds for this purpose in the Budget Act or another statute, the Superintendent of Public Instruction shall allocate funding for the purchase of standards-aligned instructional materials in visual and performing arts and world languages in kindergarten and grades 1 to 12, inclusive, and for professional development in those subjects.(b) The Superintendent of Public Instruction shall apportion funds to school districts, county offices of education, charter schools, and the state
special schools on the basis of an equal amount per unit of regular average daily attendance, as those numbers were reported at the time of the first principal apportionment for the 2019–20 fiscal year.
(c) Funding appropriated pursuant to this section shall be available for encumbrance through the 2025–26 fiscal year.
(d) A school district, county office of education, charter school, or state special school shall expend funds allocated pursuant to this section for any of the following purposes:
(1) Professional development for teachers, administrators, and paraprofessional educators or other classified employees involved in the direct instruction of pupils that is aligned to the adopted content standards in the subjects of visual and performing arts and world languages.
(2) Instructional materials aligned to the adopted content standards in the subjects of visual and performing arts and world languages. For purposes of this section, instructional materials include musical instruments, digital platforms and resources for instruction in all visual and performing arts disciplines and for instruction in world languages, and other materials necessary for standards-aligned instruction in visual and performing arts.
(3) It is the intent of the Legislature that materials and professional learning opportunities funded pursuant to this section reflect the cultural diversity of the state and of the world, consistent with Article 3 (commencing with Section 60040) of Chapter 1 of Part 33 of Division 4 of Title 2 of the Education Code. It is further the intent of the Legislature that the professional learning opportunities funded pursuant to this section be of high
quality, such as those offered by the University of California Subject Matter Projects in visual and performing arts and world languages.
(e) Funding allocated pursuant to this section is subject to the annual audits required by Section 41020 of the Education Code.
