An act to relating to health care coverage. add and repeal Division 122 (commencing with Section 153000) of the Health and Safety Code, relating to health care coverage.

Existing law governs the delivery of health care services to persons in the state through private and public means. Existing law, the Knox-Keene Health Care Service Plan Act of 1975, provides for the licensure and regulation of health care service plans by the Department of Managed Health Care and makes a willful violation of that act a crime. Existing law also provides for the regulation of health insurers by the Department of Insurance. Existing law provides for the Medi-Cal program, which is administered by the State Department of Health Care Services, under which qualified low-income individuals receive health care services. The Medi-Cal program is, in part, governed and funded by federal Medicaid Program provisions.
This bill would declare the intent of the Legislature to enact legislation that would create a blue
ribbon commission that would study how the state can move toward ensuring health coverage for all Californians. create the 9-member Health Care for All Commission in the State Department of Health Care Services, for the purpose of investigating and making recommendations on improving health care access and affordability for all Californians. The bill would require the Governor, the Senate Rules Committee, and the Speaker of the Assembly to each appoint 3 members of the commission, and require the commission to elect its chair from among its members. The bill would require the commission to meet quarterly between January 1, 2018, and January 1, 2020, and during that time period investigate issues related to improving health care access and affordability for all Californians. The bill would, following the investigation, require the commission to provide a report and recommendations regarding its findings to the Legislature.
The bill would require the State Department of Health Care Services to provide general support and staff assistance to the commission.

The people of the State of California do enact as follows:
SECTION 1.
Division 122 (commencing with Section 153000) is added to the Health and Safety Code, to read:DIVISION 122. Health Care for All Commission
153000.
For purposes of this division, the following definitions shall apply:(a) “Commission” means the Health Care for All Commission established pursuant to this division.
(b) “Department” means the State Department of Health Care Services.

The Health Care for All Commission is established in the State Department of Health Care Services.153002.
(a) The commission shall consist of nine members, each of whom shall have expertise or work experience in the field of health care.(b) No later than February 1, 2018, the Governor, the Senate Rules Committee, and the Speaker of the Assembly shall each appoint three members to the commission. The commission shall elect its chair from among its members.
(c) A member of the commission shall serve on the commission until January 1, 2021.
(d) A member of the commission shall serve without compensation, but shall be reimbursed his or her actual and necessary expenses incurred in connection with the performance of his
or her duties as a member of the commission.
(e) A member of the commission may be removed for cause by a majority vote of the members of the commission. In the event of a vacancy the chair shall appoint a replacement.

(a) The commission shall meet quarterly between January 1, 2018, and January 1, 2020.(b) The commission shall, until January 1, 2020, investigate issues related to improving health care access and affordability for all Californians.
(c) After the commission’s investigation is concluded, the commission shall, no later than July 1, 2020, report its findings to the Legislature and make recommendations for improving health care access and affordability based on those findings. The report shall comply with Section 9795 of the Government Code.

The commission shall comply with the Bagley-Keene Open Meeting Act (Article 9 (commencing with Section 11120) of Chapter 1 of Part 1 of Division 3 of Title 2 of the Government Code).153006.
This division shall remain in effect only until January 1, 2021, and as of that date is repealed.It is the intent of the Legislature to enact legislation that would create a blue ribbon commission that would study how the state can move toward ensuring health care coverage for all Californians.
