An act to add Section 2070.5 to the Fish and Game Code, relating to fish and wildlife. protected species.

Fish and wildlife: California Endangered Species Act: Delta smelt.
The California Endangered Species Act requires the Fish and Game Commission to establish a list of endangered species and a list of threatened species and requires the commission to add or remove species from either list if it finds, upon the receipt of sufficient scientific information, that the action is warranted. The act prohibits the taking of an endangered or threatened species, except as specified.
This bill would require the commission to remove the Delta smelt from the endangered species list.
The California Constitution provides for the delegation to the Fish and Game Commission powers relating to the protection and propagation of fish and game. Existing statutory law delegates to the commission the power to regulate the taking or possession of birds, mammals, fish, amphibians, and reptiles in accordance with prescribed laws. Under existing law, the Department of Fish and Wildlife exercises various functions with regard to the taking of fish and wildlife.
This bill would state the intent of the Legislature to enact legislation relating to Delta smelt.

The people of the State of California do enact as follows:
SECTION 1.
Section 2070.5 is added to the Fish and Game Code, to read:2070.5.
Notwithstanding any other law, the commission shall remove the Delta smelt (Hypomesus transpacificus) from the endangered species list established pursuant to Section 2070.It is the intent of the Legislature to enact legislation relating to Delta smelt.
