AB 1031, as amended, Villapudua. Economic development. State agencies: interns and student assistants: hiring preference.
Existing law provides that a person who deprives or violates the personal liberty of another with the intent to obtain forced labor or services or for effecting or maintaining other specified felonies is guilty of the crime of human trafficking. Existing law creates the Human Trafficking Victims Assistance Fund and requires money in the fund to be used by the Office of Emergency Services for the distribution of grants, as specified, to qualified nonprofit organizations, as defined, providing services to victims of human trafficking.
Existing law requires state agencies, when hiring for internships and student assistant positions, to give preference, as defined, to persons up to 26 years of age who are, or have been, dependent children in foster care, homeless youth, or formerly incarcerated youth.
This bill would require state agencies, when hiring for internships and student assistant positions, to give preference, as defined, to persons who have been a victim of human trafficking.

Existing law, the Small Business Financial Assistance Act of 2013, requires a corporation, as defined, to implement its responsibilities under the act by, among other things, performing outreach to low-resource small businesses and microbusinesses. Existing law makes related findings.

This bill would make a nonsubstantive change to these findings.

The people of the State of California do enact as follows:


SECTION 1.

 Section 18220.1 is added to the Government Code, to read:

18220.1.
 (a) State agencies, when hiring for internships and student assistant positions, shall give preference to a qualified applicant who has been a victim of human trafficking.
(b) For the purpose of this section, the following definitions shall apply:
(1) “Human trafficking” means a violation of Section 236.1 of the Penal Code.
(2) “Preference” means priority over similarly qualified applicants for placement in the position.

SECTION 1.Section 63088.1 of the Government Code is amended to read:
63088.1.

The Legislature finds all of the following:

(a)Small businesses form the core of the California economy and that it is in the state’s interest to increase opportunities for entrepreneurs, the self-employed, and microbusiness and small business owners to have better access to capital and other technical resources.

(b)Unemployment in California is a matter of statewide concern requiring concerted public and private action to develop employment opportunities for the disadvantaged, unemployed persons, veterans, and youth.

(c)It is necessary to direct additional capital, general management assistance, business education, and other resources to encourage the development of small business opportunities, particularly for minorities, women, and disabled persons, to alleviate unemployment.
