AN ACT

 

amending section 28‑4138, Arizona Revised Statutes; relating to mandatory motor vehicle insurance.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 28-4138, Arizona Revised Statutes, is amended to read:

START_STATUTE28-4138.  Charges of violations

A.  A person may be charged for a violation of section 28‑4135, subsection A or B, or both.  Only one penalty shall be imposed against a person charged and found to have violated both sections subsections arising out of the same series of acts.

B.  Suspensions imposed pursuant to section 28‑4135 are in addition to any suspensions that may be imposed by the department pursuant to this article.

C.  In imposing a civil penalty arising out of the same series of acts for which the department issued a suspension, the court may order a suspension issued pursuant to section 28‑4135 to run concurrently with any suspension ordered by the department.END_STATUTE
