AN ACT

 

amending title 44, Arizona Revised Statutes, by adding chapter 40; relating to trade and commerce.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 44, Arizona Revised Statutes, is amended by adding chapter 40, to read:

CHAPTER 40

NO FLY LIST

ARTICLE 1. GENERAL PROVISIONS

START_STATUTE44-8101. No fly list; Arizona residents; due process; enforcement; arrest; prosecution

A. Notwithstanding any other law, the federal government may not place a resident of this state on the federal no fly list before providing the resident due process.

B. A person who enforces a no fly list against a person who is not afforded due process pursuant to subsection A of this section is subject to arrest and prosecution. END_STATUTE
