SENATE BILL 1051

 

 

AN ACT

 

Repealing section 41‑3020.19, Arizona Revised Statutes; amending title 41, chapter 27, article 2, Arizona Revised Statutes, by adding section 41‑3028.19; appropriating monies; Relating to the department of health services.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Repeal

Section 41-3020.19, Arizona Revised Statutes, is repealed.

Sec. 2.  Title 41, chapter 27, article 2, Arizona Revised Statutes, is amended by adding section 41-3028.19, to read:

START_STATUTE41-3028.19.  Department of health services; termination July 1, 2028

A.  The department of health services terminates on July 1, 2028.

B.  The provisions of title 36 relating to the department of health services and its divisions and this section are repealed on January 1, 2029. END_STATUTE

Sec. 3.  Appropriations; public health emergencies fund; coronavirus disease 2019; reversion

A.  The sum of $5,000,000 is appropriated from the budget stabilization fund established by section 35‑144, Arizona Revised Statutes, in fiscal year 2019-2020 to the public health emergencies fund established by section 36‑122, Arizona Revised Statutes.

B.  The sum of not more than $50,000,000 is appropriated from the budget stabilization fund established by section 35‑144, Arizona Revised Statutes, in fiscal year 2019‑2020 to the public health emergencies fund established by section 36‑122, Arizona Revised Statutes.  The monies appropriated in this subsection shall be used to pay the expenses of public health emergency responses of this state following a state of emergency declaration by the governor related to the coronavirus disease 2019 (COVID‑19).  Before spending the monies appropriated in this subsection, the director of the department of health services shall notify the joint legislative budget committee of the intended use of the monies.

C.  Notwithstanding sections 35‑190 and 36‑122, Arizona Revised Statutes, the appropriation made in subsection B of this section that is unexpended and unencumbered on June 30, 2021 reverts to the budget stabilization fund established by section 35‑144, Arizona Revised Statutes.

Sec. 4.  Purpose

Pursuant to section 41‑2955, subsection B, Arizona Revised Statutes, the legislature continues the department of health services to protect the physical and mental health of the people of this state and to promote the highest standards for licensed health care institutions, emergency services and care facilities for adults and children.

Sec. 5.  Intent

In response to the declaration of emergency and executive order issued on March 11, 2020, the legislature intends that the appropriations made in this act will provide immediate additional resources and further access to an increased capacity of public health emergency funding.  The legislature will continue to work with the governor to combat and contain COVID‑19.

Sec. 6.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
