A Concurrent Resolution

 

proposing an amendment to the Constitution of Arizona; amending article XXII, Constitution of Arizona, by adding section 23; relating to energy.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1. Article XXII, Constitution of Arizona, is proposed to be amended by adding section 23 as follows if approved by the voters and on proclamation of the Governor:

23. Restrictions based on energy source; prohibition; definition

A. Section 23. This state, a city, town, county or political subdivision of this state or a public body may not restrict the manufacture, use or sale of a device based on the energy source that is either used to power the device or consumed by the device.

B. For the purposes of this section, "used to power the device or consumed by the device" means a significant function of the device uses the energy source or consumes the energy source to accomplish the function.

2. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
