A CONCURRENT RESOLUTION

 

proposing an amendment to the CONSTITUTION of Arizona; amending article V, section 6, CONSTITUTION of Arizona; relating to vacancy in the office of governor.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Article V, section 6, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

START_STATUTE6.  Death, resignation, removal or disability of governor; temporary vacancy; succession to office; impeachment, absence from state or temporary disability

Section 6.  In the event of the death of the governor, or his the governor's resignation, removal from office, or permanent disability to discharge the duties of the office, the secretary of state, if holding by election, shall succeed temporarily to the office of governor until his a successor shall be is elected and shall qualify qualifies.  The successor to the governor shall be elected at a special election called for that purpose within six months after the vacancy occurs or at a general election if that general election occurs within six months after the vacancy occurs.  The person elected at that special or general election shall serve the remainder of the vacating governor's term.  If the secretary of state be holding otherwise than by election, or shall fail to qualify as governor, the attorney general, the state treasurer, or the superintendent of public instruction, if holding by election, shall, in the order named, succeed temporarily to the office of governor. The taking of the oath of office as governor by any person specified in this section shall not constitute resignation from the office by virtue of the holding of which he the person qualifies to serve temporarily as governor.  for any temporary vacancy in the office of secretary of state that occurs as a result of the secretary of state TEMPORARILY serving as governor, the legislature shall appoint a temporary secretary of state who shall serve until the secretary of state returns from serving temporarily as governor.  If the attorney general, state treasurer or superintendent of public instruction serves temporarily as governor, the legislature shall similarly appoint a temporary state officeholder who shall serve until the officer serving temporarily as governor returns to the office to which that officeholder was elected.  Any temporary or elected successor to the office of governor shall become governor in fact and entitled to all of the emoluments, powers and duties of governor upon taking the oath of office.

In the event of the impeachment of the governor, his the governor's absence from the state, or other temporary disability to discharge the duties of the office, the powers and duties of the office of governor shall devolve upon the same person as in case of vacancy, but only until the disability ceases. 2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
