AN ACT

 

establishing the 4G and 5G cellular tower study committee.

Be it enacted by the Legislature of the State of Arizona:

Section 1. 4G and 5G cellular tower study committee; membership; duties; report; delayed repeal

A. The 4G and 5G cellular tower study committee is established consisting of the following members:

1. One member of the senate who is appointed by the president of the senate.

2. One member of the house of representatives who is appointed by the minority leader of the house of representatives.

3. One corporation commissioner who will serve as chairperson of the committee.  This member shall be appointed by the chairperson of the corporation commission.

4. Four members appointed by the league of Arizona cities and towns as follows:

(a) One member who represents a city or town in Maricopa county.

(b) One member who represents a city or town in Pima county.

(c) Two members who represent a city or town in a county other than Maricopa or Pima and who are not from the same county.

5. Two public members who are appointed by the governor.

B. Appointed members serve at the pleasure of the person who made the appointment.

C. Committee members are not eligible to receive compensation, but members appointed by the governor are eligible for reimbursement of expenses under title 38, chapter 4, article 2, Arizona Revised Statutes.

D. The committee shall:

1. Study:

(a) Blight caused by small cellular towers.

(b) Health effects caused by 4G and 5G cellular towers.

(c) Privacy issues relating to 4G and 5G cellular towers.

(d) Current law affecting the installation of 4G and 5G cellular towers, including any preemption of municipalities at the state and federal levels.

(e) Other issues that the committee determines are necessary.

2. Have subpoena power against all telecommunications entities operating in this state for materials that are germane to the committee's study.

3. Have its first meeting on December 1, 2021 and shall meet at least monthly.

4. On or before December 15, 2022, submit a report regarding the committee's activities and recommendations for administrative or legislative action to the governor, the president of the senate, the speaker of the house of representatives, the joint legislative budget committee and the corporation commission and provide a copy of this report to the secretary of state.

E. This section is repealed from and after September 30, 2023.
