HOUSE BILL 2805

 

 

 

AN ACT

 

establishing the Arizona election process study committee.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Arizona election process study committee; membership; duties; report; delayed repeal

A.  The Arizona election process study committee is established consisting of the following persons:

1.  One representative of a county who is appointed by the speaker of the house of representatives.

2.  One county elections director who is appointed by the president of the senate.

3.  One city or town elections director who is appointed by the governor.

4.  Two members of the house of representatives who are appointed by the speaker of the house of representatives and who are members of different political parties.  The speaker of the house of representatives shall designate one of these members as cochairperson of the committee.

5.  Two members of the senate who are appointed by the president of the senate and who are members of different political parties.  The president of the senate shall designate one of these members as cochairperson of the committee.

B.  Committee members are not eligible to receive compensation.

C.  The committee shall review and consider recommendations regarding the following for the most recent elections:

1.  Polling place opening and closing times and the number of polling places that did not open on time.

2.  Voting center and emergency voting center activities and problems.

3.  Provisional ballots, including their use in polling places and voting centers and the process for verifying and tabulating those ballots.

4.  Ballot tabulation processes for regular ballots.

5.  Voter suppression claims.

6.  Whether the secretary of state is in compliance with federal and state law with respect to the statewide voter registration database.

7.  Whether the secretary of state is in compliance with state and federal election laws generally.

D.  On or before December 31, 2020, the committee shall submit a report on its findings and recommendation to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state and the attorney general.

E.  This section is repealed from and after March 31, 2021.
