AN ACT

 

amending title 23, chapter 2, article 8, Arizona Revised Statutes, by adding section 23-366; relating to the minimum wage.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, title 23, chapter 2, article 8, Arizona Revised Statutes, is amended by adding section 23-366, to read:

START_STATUTE23-366. Student employees; employment classification; minimum wage

A. The student employee employment classification is established consisting of employees who are both of the following:

1. Regularly enrolled in high school. 

2. Only work after school hours or when school is not in session.

B. Notwithstanding any other law, From and after December 31, 2021, an employer that employs a student employee shall pay the student employee a minimum wage rate of at least $8.50 an hour.

C. An employer that employs student employees shall comply with all relevant state and federal laws relating to youth employment. END_STATUTE

Sec. 2. Requirements for enactment; three-fourths vote

Pursuant to article IV, part 1, section 1, Constitution of Arizona, section 23-366, Arizona Revised Statutes, as added by this act, is effective only on the affirmative vote of at least three-fourths of the members of each house of the legislature.
